Gaur Family Law (the legal practice of Gaur Law Professional Corporation) ("Gaur Family Law", "we", "us", or "our") is committed to protecting your privacy and the confidentiality of your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), and our professional obligations under the Law Society of Ontario.

This Policy applies to personal information we collect through our website (the "Site"), email or web forms, events, and in the course of providing legal services. A separate engagement letter and our professional obligations govern client files and privileged information; where there is any inconsistency, our legal and professional obligations prevail.

1. What We Collect

The personal information we collect depends on your interactions with us:

  • Contact & Identity Information – name, address, email, phone number, preferred pronouns, and identification details provided for client identification/verification.
  • Matter Information – details you provide about your legal issue, counterparties, documents, court filings, and related communications.
  • Billing & Payment Information – retainer amounts, invoices, payment history, and (where applicable) limited payment card details processed through our payment processors.
  • Technical & Usage Data – IP address, device/browser type, pages visited, time/date, referring URL, and cookies or similar technologies. (See Cookies & Analytics below.)
  • Recruitment Information – resumes, cover letters, references, and related information if you apply for a role.

We generally collect information directly from you or your authorized representatives. We may also receive information from third parties such as opposing counsel, courts/tribunals, experts, process servers, financial institutions, and publicly available sources, where permitted by law and necessary to your matter.

2. Why We Use Your Information (Purposes)

We use personal information to:

  • Provide legal services and manage our solicitor–client relationship, including advice, strategy, advocacy, document preparation, filing, service, negotiations, and settlement.
  • Verify identity, conduct conflicts checks, and comply with Law Society of Ontario and anti money laundering requirements.
  • Communicate with you about appointments, updates, and documents; respond to inquiries; and provide client care.
  • Administer our practice (file opening/closing, trust accounting, billing, collections, audits, and internal reporting).
  • Improve our Site (troubleshooting, analytics, and security monitoring) and, with consent where required, to send newsletters or event information.
  • Protect our rights and our clients’ interests, including fraud prevention, security, and legal or regulatory compliance.

We will not use personal information for additional purposes without your consent, unless permitted or required by law.

3. Legal Bases & Consent

Where required, we collect, use, and disclose personal information based on one or more of the following:

  • Your consent (express or implied), which you may withdraw at any time, subject to legal or contractual restrictions and reasonable notice.
  • Performance of a retainer/engagement and steps requested by you before entering into a retainer.
  • Compliance with legal obligations (e.g., record keeping, client identification/verification, court orders).
  • Legitimate interests such as practice management, information security, and prevention of fraud or abuse, balanced against your privacy rights.

Withdrawing consent may affect our ability to provide certain services. We will advise you of any implications at the time of your request.

4. Cookies & Analytics

Our Site may use cookies and similar technologies (e.g., pixels, local storage) to:

  • Keep the Site secure and functioning (strictly necessary cookies)
  • Remember preferences (functional cookies)

We require service providers to safeguard personal information and use it only for the services we request.
  • Legal/Regulatory – to courts/tribunals, law enforcement, regulators (including the Law Society of Ontario), or as otherwise required or permitted by law.
  • Business Continuity – in connection with a reorganization, merger, or other change in our practice, subject to appropriate safeguards and continued confidentiality.

We do not sell your personal information.

6. Cross Border Transfers

Some service providers may store or access personal information outside of Ontario or Canada. When information is processed in another jurisdiction, it may be subject to that jurisdiction’s laws. We take contractual and organizational measures to protect personal information transferred across borders.

7. Safeguards

We employ administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including:

  • Access controls and need to know limitations
  • Secure file storage and encrypted transfers where applicable
  • Professional confidentiality, privilege, and staff training
  • Secure disposal and retention protocols

No system is perfectly secure, but we continually assess and improve our safeguards.

8. Retention

We retain personal information only as long as necessary to fulfill the purposes for which it was collected, to meet legal, regulatory, audit, or insurance requirements, and in accordance with Law Society of Ontario record retention expectations. When information is no longer required, we securely destroy, anonymize, or archive it per our retention schedule.

Subject to limited exceptions under law and privilege, you may:

  • Access your personal information and request details about how it has been used or disclosed
  • Request corrections to inaccurate or incomplete information
  • Withdraw consent to future uses/disclosures (where consent is the basis)
  • Opt out of non essential cookies or marketing communications
